Judge Luciano Rinaldi, from the Rio Court of Justice, suspended this Monday (9/7) an injunction that prohibited the import and sale of the Chinese car Lifam 320, which BMW accuses of being an imitation of the Mini Cooper. A court decision, dated May 18, prohibited the sale, a determination that had to be fulfilled within 60 days. The information is from the newspaper Folha de S.Paulo. When suspending the effects of this Lithuania Email List decision, Rinaldi claimed that the order to remove Chinese vehicles from the market should only be taken when there is a final position on the issue. Lifam began to be sold in the country in 2008 and this year 629 units have already been sold. BMW accuses the company Ever Electric, representative of the Chinese in Brazil, of promoting "unfair and parasitic competition, by imitating the visual appearance of the Mini Cooper". In court, lawyers from the firm Danneman Siemsen, representatives of BMW, accuse the Chinese manufacturer of copying even the stylization of the painting. Ever Electric's defense says that there would be no unfair competition because the characteristics are different.
